TERMS OF SERVICE

Preamble
These Terms of Service ("Terms") govern the contractual relationship between Alex Bossé("the DJ," "we," "our") and any individual or legal entity who retains our professional DJ services ("the Client," "you," "your").
Any booking confirmed by payment of a deposit constitutes full acceptance of these Terms, which are restated and tailored in the event-specific service contract.
1. Definitions
DJ: Alex Bossé, sole proprietor with principal place of business in Edmundston, New Brunswick.
Client: the person who retains the DJ for a given event.
Event: the performance the DJ undertakes to provide on the date, time and at the location set out in the contract.
Contract: the written document (signed electronically or on paper) setting out the service, price, date, and location.
Deposit: 50% of the total price, paid at booking confirmation.
Balance: total price less the Deposit, payable 7 days before the Event.
2. Services
Services may include, as set out in the contract: musical entertainment, live mixing, provision and setup of sound and lighting equipment, MC duties (on request), tailored playlists, coordination with the venue or wedding planner, and headline performance on the day.
The exact scope is set in the service contract. These Terms apply across all services rendered.
3. Booking and confirmation
A booking request submitted via the site does not bind the DJ. A date is considered booked only once:
(i) both parties have signed the contract; and
(ii) the DJ has received the 50% Deposit.
Until both conditions are met, the date remains available and may be allocated to another client.
4. Rates and invoicing
Rates are those in effect on the date the contract is signed and as set out in the contract. Unless stated otherwise, they are in Canadian dollars (CAD) and include applicable taxes only if the DJ is registered for GST/HST and QST at invoicing. If the DJ becomes registered after the contract is signed, taxes will be added on amounts remaining payable.
Travel costs beyond 100 km of Edmundston, additional equipment requested by the Client, and any performance time beyond the contracted duration may give rise to additional fees specified in the contract.
5. Deposit, payments and — IMPORTANT — cancellation policy
PLEASE READ CAREFULLY. This section sets out the financial consequences of cancellation or rescheduling. By paying the deposit, you acknowledge that you have read and accepted this section.
5.1 50% deposit — non-refundable
A deposit of 50% of the total price is payable on booking confirmation. This deposit is non-refundable, regardless of when or why the Client cancels.
Why the deposit is non-refundable. When the DJ accepts a booking, the date is exclusively blocked in the DJ's calendar. The DJ actively turns away every other inquiry for that same date — often several inquiries during peak weekend dates. The deposit therefore compensates the real lost-opportunity cost the DJ incurs: it is the price of the date's exclusivity. This approach is consistent with industry practice across the Canadian events sector and represents the consideration for the DJ's commitment to be available for you.
5.2 Balance — due 7 days before the event
The balance (the remaining 50%) is due no later than 7 calendar days before the event date, by bank transfer, Stripe payment, or any other method agreed in the contract. Failure to pay the balance by that deadline is a default by the Client.
5.3 Cancellation by the Client
Cancellation at any time up to the 7th day before the event: the 50% Deposit is retained by the DJ as liquidated damages. No further amount is payable.
Cancellation within the 7 calendar days before the event: the full contract price remains owed, because the balance had already become due and the DJ no longer has a reasonable window to re-fill the date.
5.4 Cancellation by the DJ
If the DJ is unable to perform (outside cases of force majeure under section 8):
Full refund: all amounts already paid by the Client (deposit plus any balance) will be refunded within 15 calendar days.
Reasonable replacement effort: the DJ will make a good-faith effort to recommend a replacement DJ of comparable calibre from the DJ's professional network. This recommendation comes with no guarantee.
Replacement's rate: if the Client retains the replacement DJ, the rate agreed with that replacement DJ is negotiated and paid directly between the Client and the replacement DJ. Alex Sparks is not responsible for any difference if the replacement charges more than the DJ's original rate.
No replacement found: if no satisfactory replacement is found, the full refund is the Client's sole remedy, to the exclusion of any other compensation.
5.5 Rescheduling
One (1) free reschedule is granted to the Client, on the following cumulative conditions:
the reschedule request must be sent in writing (email) at least 30 calendar days before the original event date;
the new date must be after the original date (rescheduling to an earlier date is not allowed);
the new date is subject to the DJ's availability;
all other terms of the contract (price, duration, general location) remain unchanged.
Late reschedule request (less than 30 days): subject to the DJ's discretionary acceptance. If refused, cancellation under section 5.3 applies.
Second or further reschedule: treated as a new booking. The deposit paid for the first date is forfeited and a new 50% deposit is payable at the applicable rate for the new date.
6. Client obligations — facilities and on-site support
Depending on the nature of the event and the venue, the Client undertakes to provide the DJ, at the Client's expense and no later than the DJ's arrival time:
Power: a dedicated circuit at the DJ setup point, with no competing equipment sharing that circuit (overloads are the single most common cause of technical incidents at events).
Parking: free parking reasonably close to the load-in/load-out area, large enough for an equipment vehicle (van or SUV).
Security: for any event of more than 100 guests, or any event the DJ deems higher-risk (e.g., a public event with alcohol service), the Client is responsible for engaging adequate security at the venue.
Indoor backup plan ("rain plan"): for any outdoor event, the Client must arrange and confirm to the DJ, at least 48 hours before the event, a covered indoor backup option in case of bad weather. The DJ reserves the right not to set up or operate electronic equipment in the rain or in conditions that put safety or equipment at risk.
A Client's failure to provide these may delay the start of the performance without compensation, or suspend the performance in cases of serious risk (e.g., absence of compliant electrical supply).
7. Conduct, work environment, and right of refusal
The DJ undertakes to provide a professional, punctual, and respectful performance. The Client undertakes to provide the DJ with a safe and harassment-free working environment.
The DJ reserves the right to interrupt the performance, without refund, if:
the DJ's safety or the safety of the equipment is compromised (violence, vandalism, aggressive intoxication of guests);
the Client or the Client's guests subject the DJ to harassment (discrimination, sexual harassment, intimidation);
the imposed conditions (acoustic, electrical, climatic) put health or equipment at risk.
In those circumstances, the performance is deemed delivered and no refund is owed.
8. Force majeure
8.1 Definition
A force majeure event is any unforeseeable, irresistible, and external event consistent with article 1470 of the Civil Code of Québec, including but not limited to: a pandemic or epidemic declared by health authorities, a government order or prohibition preventing the event, a major natural disaster (severe storm, ice storm, flood, fire), a major strike affecting transport or energy infrastructure, or a medically certified serious illness or injury of the DJ that prevents performance.
8.2 Effects
Either party may invoke force majeure in writing as soon as possible after becoming aware of the event.
Rescheduling preferred: the parties will work in good faith to agree a new date. Such a reschedule based on force majeure is not counted as the "one (1) free reschedule" referred to in section 5.5.
Cancellation if no reschedule is possible: if no alternative date can be agreed within a reasonable time, the contract is terminated. The DJ refunds the Deposit and any other amount paid, less reasonable already-incurred and non-recoverable expenses (e.g., specific equipment rental fees, non-refundable travel costs), supported by receipts.
No further recourse: neither party may claim further damages from the other for the consequences of a force majeure event.
9. Limitation of liability
Subject to applicable law, and without derogating from the protections of the Civil Code of Québec, the New Brunswick Consumer Protection Act (when in force), or any other mandatory regime:
the DJ's total liability to the Client, on all heads of damage combined, shall not exceed the total amount actually paid by the Client under the contract;
the DJ is not liable for indirect, consequential, or punitive damages, nor for loss of profit, reputation, or business opportunity;
the DJ is not liable for technical failures attributable to equipment or facilities provided by the Client or the venue (venue power outage, in-house sound failure, etc.).
Nothing in these Terms limits the DJ's liability for gross or intentional fault, or for bodily injury.
10. Copyright and music licensing
In Canada, SOCAN and Re:Sound royalties owed for the public performance of recorded music at private receptions are the responsibility of the venue or event organizer (SOCAN Tariff 8 and Re:Sound Tariff 5.B), not the DJ. The Client confirms it has verified, with the venue, that the applicable royalties are paid.
Tracks used by the DJ are lawfully acquired (digital purchases, DJ streaming services) and used in accordance with the applicable licences. The DJ retains exclusive ownership and possession of equipment and music library.
11. Image rights
Unless the Client objects in writing before the event, the DJ may take photographs and short videos of the setup and general atmosphere (without identifiable close-ups of guests) for portfolio and promotion purposes on the DJ's site, social media, and professional materials.
If the Client wishes to restrict this use, it must be noted in the contract or by email at least 24 hours before the event.
12. Subcontracting
The DJ may, where necessary (technical support, second DJ for a larger event), engage a qualified subcontractor. The DJ remains responsible to the Client for overall delivery.
13. Personal data
The processing of the Client's personal information is governed by the Privacy Policy available at alexsparks.ca/en/privacy-policy, which forms an integral part of these Terms.
14. Contract changes
Any change to the main contract (date change under a reschedule, change of start time, added services, change of venue) must be in writing (email expressly accepting the change, or amendment to the contract).
15. Amicable resolution and jurisdiction
In case of a dispute, the parties undertake to attempt an amicable resolution through direct communication before any legal action.
Failing that:
for a Client domiciled in New Brunswick: the courts of New Brunswick, in the judicial district covering Edmundston, have jurisdiction.
for a Client domiciled in Québec: the courts of Québec, in the district covering either the event location or the Client's domicile at the Client's option, have jurisdiction, in accordance with article 3148 of the Civil Code of Québec. Québec law applicable to consumers (including the Québec Consumer Protection Act) applies to Québec consumer Clients and prevails over any inconsistent provision herein.
16. Severability
If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in force.
17. Entire agreement
These Terms, together with the service contract and the Privacy Policy, constitute the entire agreement between the parties relating to the event.
18. Changes to these Terms
The DJ may update these Terms. The version that applies to your event is the one in effect on the date your contract is signed, unless otherwise agreed in writing.
